Premise and Definition

Busrapido is a regularly registered trademark owned by BusForFun.com srl (IT 04322330277) and identifies the set of services offered through the digital platform, as well as the management, customer assistance and operational support activities carried out by the appointed personnel.

BusForFun operates as the contractual counterpart of the User in relation to the booking, payment and management of the service, also on behalf of the transported passengers.

The present General Conditions of Transport (the "Conditions") regulate the relations between the end users of the transport services (hereinafter, the "Users") and BusForFun.com S.r.l. (hereinafter, "BusForFun"), as well as the modalities of provision of the transport services provided by third-party operators (hereinafter, the "Suppliers"). The present conditions completely replace any previous version starting from June 1, 2026.

The Transport Services will be provided through the booking platform "Busrapido" (hereinafter "the Platform").

For the purposes of the present Conditions, by "User" is intended any natural or legal person who accesses the platform owned by BusForFun, named Busrapido, and books, purchases or uses, in any capacity, the transport services offered therein, whether on their own behalf or on behalf of third parties, assuming in such case all responsibility in relation to the correctness of the data provided and the compliance with the present conditions by the transported subjects.

It is specified that, in the case of Users acting in the exercise of entrepreneurial or professional activity (B2B), the provisions of the Consumer Code DO NOT apply.

By "Booking User" is intended the natural or legal person who accesses the BusForFun platform and proceeds to the booking and/or purchase of the transport services, in their own name and on their own behalf or of third parties, assuming all responsibility regarding the correctness of the data provided and the compliance with the present General Conditions of Transport.

By "Passenger" is intended the natural person who concretely uses the transport service, regardless of whether or not they coincide with the Booking User who remains the sole legal interlocutor of Busforfun regardless of their personal participation in the service.

By "Supplier" is intended the third-party operator, natural or legal person, titular, owner and/or manager of the means of transport, who executively provides the transport services booked through the Busrapido platform, in possession of the requirements and authorizations foreseen by current legislation.

It is understood that BusForFun, despite being the sole interface of the User and the subject with whom the contractual relationship occurs, does not assume the role of carrier and is not directly responsible for the execution of the transport service, which remains entirely with the Supplier.

The present premises and definitions become an integral and essential part of the present contract.

 

Service Program and Travel Route

The travel route is established based on the choice that the Supplier considers most economical and safe for both parties. It will then be the task of Busrapido to communicate it to the User.

The program is agreed upon between the Parties in the estimate phase.

For any variations during the route, communication to BusForFun is necessary, which will respond regarding the feasibility upon prior authorization of the Supplier. The variation will be annotated directly on the driver's travel sheet and countersigned by the customer.

 

Regulation of the Transport Service

The Service Program is defined by the User in the booking phase and has an indicative value for the purposes of the organization of the transport.

The actual route, including any stopping points, travel times and operational modalities, is determined by the Supplier on the basis of criteria of safety, road conditions, current legislation and economic optimization of the service. BusForFun will proceed to communicate the details to the User before the execution of the Service.

Any request for variation of the Program or of the route during the execution of the Service must be promptly communicated to BusForFun and will be subject to verification of operational, technical and normative feasibility, as well as to the prior authorization of the Supplier.

It is understood that any variations requested by the User may entail additional costs, which will be communicated and must be accepted before their execution. In the absence of authorization, the Service will continue according to what was originally planned or according to what is deemed most appropriate by the Supplier.

The Supplier reserves in any case the right to modify the route or the modalities of execution of the Service even without prior authorization of the User, should this be necessary to guarantee the safety of the passengers or the compliance with the applicable legislation.

 

Departure Location (Pick-up) and place of Unloading (Drop-off)

It is the task of the User to ensure that the indicated departure address allows easy loading and unloading operations. In the event that the vehicle is unable to reach the requested pick-up place, the Supplier will avail itself of the right to modify the departure address requested by the User with an address close to it.

The same conditions also apply to the place of Unloading or drop-off.

 

General regulations for passengers on board

The User is required to prepare the list of the names of the passengers participating in the trip and commits to exhibiting it or sending a copy of it, should it be requested by the Authorities or by BusForFun or by the Supplier. The presence of this list is always mandatory.

On board the vehicle, passengers are forbidden to:

  • speak with the driver or distract him during driving, as well as adopt behaviors that may compromise the safety of the trip;

  • cause disturbance to the other passengers (therein including shouts, clamors or harassing behaviors);

  • smoke, also by means of electronic cigarettes;

  • consume alcoholic beverages or take narcotic substances, as well as board in a state of intoxication or in evident psycho-physical alteration;

  • consume food and beverages without prior authorization from the driver;

  • stand along the aisle during the trip or encumber the boarding, alighting and passage areas;

  • tamper with or improperly use the equipment and endowments of the vehicle;

  • throw objects from the vehicle;

  • transport dangerous, harmful or offensive substances, materials or objects, including firecrackers, smoke bombs and weapons of any type (even toys if not adequately guarded).

It is furthermore made obligatory for passengers to:

  • occupy only one seat;

  • use the seat belts and any restraint devices present;

  • maintain a behavior respectful of the cleanliness of the vehicle and the equipment;

  • comply with the provisions given by the driver, by the carrier or by any competent authorities, also on the occasion of stops or controls;

  • not compromise in any way the regularity of the service and the level of safety.

Any behavior diverging from what is described above will authorize the Supplier - by means of its delegated drivers - to take measures, such as refusing transport to any person who is under the influence of alcohol or drugs or psycho-physical alteration or who constitutes a potential danger to the driver of the vehicle and to the other passengers.

 

Regulations for minor passengers

The transport of minors is permitted in compliance with the legislation in force in the Country of execution of the service, as well as the present Conditions of Transport. It remains in any case mandatory to use the seat belts and any restraint devices for the entire duration of the trip, where foreseen.

Age groups and accompaniment

  • Minors under the age of 3 can travel exclusively if transported by means of homologated child seats, provided by the accompanying persons and correctly installed with the seat belts present on board. BusForFun and the Supplier do not assume any responsibility regarding the suitability or conformity of the devices used.

  • Minors under the age of 10 must obligatorily travel accompanied by a parent, guardian or other authorized adult subject.

  • Minors between the ages of 10 and 15 can travel unaccompanied exclusively upon prior written authorization by whoever exercises parental responsibility, to be exhibited upon request. It is understood that, for trips outside the national territory, unaccompanied minors are not admitted.

  • Minors over the age of 15 can travel without accompaniment.

Responsibilities and obligations

The parents or guardians, or the accompanying subjects, are the sole responsible parties:

  • for the correct compilation and availability of the requested documentation;

  • for compliance with the applicable regulations, with particular reference to international trips;

  • for the behavior of the minor during the trip;

  • for any damages caused by the minor to persons, goods or to the vehicle.

BusForFun and the Supplier do not provide assistance, custody or surveillance services towards minors, even if authorized to travel unaccompanied.

Any particular situations not expressly regulated must be previously agreed upon in writing with BusForFun before the booking.

In case of failure to comply with the present provisions, BusForFun reserves the right to deny access on board or to interrupt the service, without the right to any refund.

 

Regulation for Passengers with Disabilities or Reduced Mobility

BusForFun guarantees the respect of the rights of passengers with disabilities or reduced mobility pursuant to Regulation (EU) No. 181/2011, ensuring non-discriminatory access to the service and without additional costs.

The PMR passenger is invited to contact Customer Service with congruous advance with respect to the departure to allow the organization of the necessary assistance, compatibly with the characteristics of the vehicle and the infrastructures.

The transport of mobility aids (e.g., folding wheelchair, walker) is free, within the technical and safety limits of the vehicle.

Where necessary, and upon prior communication, the accompanying person of a passenger with a disability can travel for free, according to what is foreseen by the applicable legislation.

BusForFun can refuse the transport of PMR passengers exclusively for reasons of safety or technical impossibility, providing adequate motivation and proposing, where possible, an alternative.

Guide dogs for blind persons are admitted for free on board.

 

Passenger Responsibilities for International Travel

For international trips with one or more border crossings, the passenger must make himself aware of the necessity of having with him a valid identity document, suitable for expatriation.

The traveler is obliged:

  • To carry with him all documents and the identity card (or Passport) valid at the time of the execution of the trip necessary for participation in the trip and to exhibit them, where requested of him, to the driving or assistance staff of busforfun.com srl and/or of the Partner Company or by the competent Authorities;

  • To carry with him only duty-free goods (by type and quantity);

  • To facilitate customs operations, avoiding handing over locked luggage;

  • To uniquely identify all his luggage.

Exclusion of liability: The traveler is in any case responsible for compliance with the regulations relating to the necessary documents and/or visas, as well as the regulations concerning currency, customs and health protection.

The consequences of failure to comply with such regulations (such as, by way of pure example, the impossibility of making entry into the destination Country) will remain at the expense of the traveler and cannot in any way be imputed to Busforfun.com srl and/or to the Partner Company, even if such rules should have been modified in a period subsequent to the booking of the trip. In the remote case all this happens, the transport contract must be considered completely fulfilled.

Continuation of the trip: should a passenger not be in order with the regulations for crossing a border (for example devoid of the valid document for expatriation, or expired) and be stopped at the border by the competent Authorities, the same must consider himself informed that the trip will continue regardless of his presence on board the vehicle.

 

Pre-Trip Communications

The driver's mobile phone number will be communicated to the User the day before the trip, no earlier than 8:00 PM.

 

Transport Service Costs

The price includes the vehicle rental, driver labor (the driver), consumables (fuel, lubricants, antifreeze, etc.), highway tolls, and insurance for transported third parties.

 

Additional expenses for transportation service, damage, repairs, and cleaning of the vehicle.

BusForFun commits to communicating to the User in advance all the expenses of which it is aware. It is specified that some costs are established at the municipal level and therefore subject to periodic and not always predictable variations.

Unless otherwise specified at the time of booking, the expenses borne by the User are:

  • expenses for board and lodging of the driver in the case of multi-day trips;

  • parking lots, ZTL (Restricted Traffic Zone) passes, checkpoints, entry taxes into cities, ferries, tunnels, passages, bridges, mountain passes and further similar expenses;

  • any variations of route or of times that entail for the Supplier exceeding burdens with respect to those foreseen at the time of booking.

The User will be responsible for the cost of repairing any damages or for the necessary cleaning interventions to the vehicles and to the goods of the Supplier, should such damages and the necessary cleaning interventions exceed normal "wear and tear" and be imputable to the User.

In the capacity of passenger, the User is responsible for leaving the rented vehicle in the conditions in which it was found at the time of departure. The User acknowledges and accepts that he is responsible for his own acts or omissions, as well as for the acts or omissions of any single individual he invites, or to whom access is otherwise permitted on the rented vehicle. In the event that a Supplier complains and provides proof of damages, the User agrees to repay, through BusForFun, the cost of the replacement of the damaged items.

It is up to the User to demonstrate that the damage was not caused by him or that the amount of the damage is less than the charged amount.

 

Luggage Transport

A personal luggage for each passenger is always included in the service, with maximum dimensions 40 x 30 x 20 cm, to be kept with oneself on board. Any further luggage is accepted exclusively within the limits of the maximum capacity of the vehicle's luggage compartment.

The responsibility for the loading and unloading of the luggage remains at the exclusive expense of the User. There is no obligation of handling of the luggage by the driver or other on-board personnel.

For clarifications or specific requests, it is necessary to interface directly with Customer Service.

The possible assistance provided by the driver or by other on-board personnel in the operations of loading, unloading or handling of the luggage is to be intended exclusively as an act of courtesy. In any case, the responsibility for the luggage and for its content remains entirely at the expense of the User, except in cases of willful misconduct or gross negligence.

The luggage compartment of the vehicle may be opened and closed exclusively by authorized personnel (drivers or other appointed personnel).

BusForFun is not liable, except in cases of willful misconduct or gross negligence, for the loss, theft, exchange or damage of the luggage, even if deriving from accidents or accidental events occurred during the transport.

In case of total or partial loss or destruction of the luggage due to accidental causes not imputable to willful misconduct or gross negligence of BusForFun or of the Supplier (therein including, by way of example, technical events, impacts, accidental opening of the luggage compartment or other unpredictable events), the possible compensation will be in any case limited, for each piece of luggage, to a maximum amount equal to 200.00 € (two hundred Euros) or to the different limit possibly foreseen by the applicable legislation. Any responsibility for the loss, theft or damage of valuable objects contained in the luggage is expressly excluded, such as, by way of non-exhaustive example: cash money, jewelry, precious metals, securities, documents, electronic devices, photographic cameras, medicines, glasses, prostheses and other goods of particular value or fragility, which the passenger is required to keep with himself during the trip.

In case of loss of luggage or other objects, BusForFun, also through the Supplier, will strive without obligation of result to verify their possible recovery. The retrieval of the same, as well as any possible cost for shipping, remains at the expense of the passenger.

 

Transport of Pets

The transport of animals of any type is not admitted, except upon prior written authorization of BusForFun through the Supplier. In case of authorization, the animals must be guarded in compliance with the regulations in force and the conditions established by BusForFun, and in particular they must be equipped, where foreseen, with a leash, muzzle and/or suitable carrier. The owner or keeper of the animal remains in any case fully responsible for any damages caused to persons, to the vehicle or to things during the transport, with the obligation of immediate compensation for the damages possibly caused.

Custody of Live Animals in the vehicle

It is explicitly FORBIDDEN to leave live animals unattended in the vehicle; any violation will be immediately reported to the authorities of the reference Country, with immediate suspension of the trip not imputable to Busforfun until complete restoration of the prejudice.

All possible consequent damages will be imputed to the User.

 

Waiting Times, Pick-ups, and Overtime

The User commits to observing the times agreed upon at the time of booking the transport service.

In case of booking single or multiple transfers, the vehicle will wait for the passengers at the agreed pick-up point for a maximum of 30 minutes, after which the Supplier will consider itself free from any obligation and the transport service will be considered performed. In the aforementioned case, no refund will be issued to the User.

In the event that a wait greater than 20 minutes is necessary, the User must communicate it before the execution of the transport service and, in the event the Supplier is able to satisfy the request, a sum equal to € 100 will be charged to the User for every extra hour of waiting.

In case of booking a transport service with the option "I want the bus at my disposal", the vehicle will be at the disposal of the passengers starting from the first time until the last time indicated at the time of booking.

In the event that the User requests an extension of the booked transport service, the User must communicate it before the execution of the transport service and, in the event the Supplier is able to satisfy the request and compatibly with the "General rules of driving and rest times for drivers" regulated in point 16, a sum equal to € 100 will be charged to the User for every extra hour of service.

 

Vehicle Used for the Service

BusForFun does not guarantee the availability of a specific model of vehicle.

The images and the models of motor vehicles possibly shown on the Platform have a purely illustrative character.

BusForFun reserves the right, for operational or organizational needs, to grant the Supplier to replace the foreseen vehicle with another of equivalent or superior characteristics, without this entailing any right to complaints, compensations or price reductions on the part of the User.

 

Use of seat belts and on-board behavior

Each passenger is required to respect the provisions foreseen by art. 172 of the Highway Code, as modified by Legislative Decree March 13, 2006, no. 150, implementing Directive 2003/20/EC, relating to the mandatory use of seat belts and child restraint systems in vehicles.

Passengers are therefore required to fasten their seat belts during the trip. In case of non-compliance, the transgressor answers personally for any sanctions foreseen by current legislation; should it be a matter of minors, the responsibility falls on the accompanying person or on the subject responsible for their supervision.

Any sanctions or infractions contested against BusForFun within the context of the execution of the service, but imputable to the behavior of the passengers (by way of non-exhaustive example: failure to use seat belts, request or carrying out of stops in unauthorized places, etc.), will be charged to the User, together with any administrative costs incurred for the management of the relative procedure.

 

Management of the Service

Travel times

It is specified that the travel times indicated on the BusRapido Platform at the time of booking have a purely indicative character.

The departure and arrival times displayed constitute in fact approximate travel estimates, elaborated on the basis of the calculations provided by Google Maps™ or by other navigation systems.

It is the responsibility of the User to plan the times of his trip foreseeing a sufficient margin of time for any connections with other means of transport or for the compliance with personal or professional commitments.

BusForFun cannot be held responsible for any losses of connections with other transport services, whether they be land, maritime, air or railway, regardless of the cause that has determined the delay with respect to the estimated time of arrival, except in cases of willful misconduct or gross negligence.

 

Risky Trips and Special Events

The User is required to inform BusForFun, with an advance notice of at least 14 (fourteen) days with respect to the scheduled date of departure, should the requested service concern or be connected to events that may entail particular risks for the safety of persons, of the vehicle or of the personnel.

By way of non-exhaustive example, considered as "risk trips" are services connected to football matches, derbies, sporting events, concerts, public demonstrations, marches, political events or other situations in which the significant presence of law enforcement or potential criticalities of public order is foreseeable or the execution of which requires prior authorization by a competent public authority.

In such cases BusForFun reserves the right to:

  • refuse the booking or unilaterally withdraw from the contract;

  • request particular conditions for the execution of the service, such as security supplements, presence of a group manager designated by the User, or the payment of a deposit as a guarantee for any damages to the vehicle;

  • modify, where necessary, operational modalities, routes, points of loading or unloading of passengers, in compliance with the indications of the competent authorities.

Should the User omit to communicate the nature of a "risk trip" as defined above, BusForFun reserves the right to cancel the service before the start of the trip or to interrupt it even during its execution should conditions emerge such as to compromise the safety of the service, of the personnel or of the vehicle.

In such circumstances the User will not have the right to any refund or compensation, except in the case of willful misconduct or gross negligence of BusForFun. The User furthermore remains responsible for any damages caused to the vehicle or to third parties by the transported passengers.

 

Rules on Driving and Rest Times for Drivers

 

To avoid unpleasant misunderstandings with the User and passengers, please be informed that bus drivers are bound to comply with the current regulations regarding driving and resting times.

To meet safety requirements, the transport service must strictly comply with EU Regulation No. 561/2006, which allows a driving time of:

  • A maximum of 9 hours of daily driving;

  • A maximum of 10 hours of daily driving twice a week;

  • A maximum of 56 hours of weekly driving (four days of 9 hours, and two days of 10 hours);

  • A maximum of 90 hours of driving over a two-week period.

The driver's daily driving hours must also include the driving time required to reach the departure address indicated by the User, starting from the Supplier's headquarters/depot, and to return to the Supplier's headquarters/depot once the trip is completed.

By law, the driver of the vehicle must take a break after every 4 and a half hours of driving. The break can be taken in one of the following two ways:

  • A single, uninterrupted break of 45 minutes after the 4 and a half hours of driving;

  • Two breaks, strictly of at least 15 and 30 minutes respectively, distributed within the 4 and a half hours of driving.

The second break must mandatorily be 30 minutes long, even if the first stop lasted more than 15 minutes. If necessary, the driver may, at their discretion, increase the number and duration of the driving breaks.

The driver of the vehicle must rest for 11 consecutive hours within a 24-hour period, with the possibility of an exemption 3 days a week, but in any case, never for less than 9 consecutive hours.

Every 6 days of service, the driver of the vehicle is entitled to a rest period of a minimum of 24 consecutive hours. The regular required rest is 45 consecutive hours. Should the driver rest for a fewer number of hours (for example, 24 hours), the difference, along with the corresponding compensation, must be recovered within the following three weeks.

The maximum daily commitment (shift) of the Driver is 13 hours. The driver's maximum daily commitment must also include the driving time required to reach the departure address indicated by the User, starting from the Supplier's headquarters/depot, and to return to the Supplier's headquarters/depot once the trip is completed.

If two drivers are employed and take turns driving the vehicle, within every 30 hours, both must be able to take a daily rest period of 9 uninterrupted hours.

Failure to comply with these rules results in a 2-point deduction from the driver's license, in addition to the immediate impoundment of the bus on the spot.

We therefore ask for your understanding towards the drivers should they be unable to make or extend a visit—perhaps requested at the last minute, and especially at night—or to make a detour.

 

Driver Tips

The amount paid by the User through the Platform is understood to include the full remuneration for the services provided.

Therefore, there is no obligation to leave a tip for the driver of the vehicle. However, it is understood that should the User or passengers wish to offer a voluntary contribution to the driver as a gratuity for the service received, such a gesture is to be considered entirely optional and at their own discretion.

 

Limitation of Liability and Indemnity of the Busrapido Platform

BusForFun.com S.r.l., through the Busrapido Platform, acts exclusively as a technological and commercial intermediary to allow the User to book transport services provided by third-party operators.

The User acknowledges that, although booking, payment, and communications occur exclusively through the Platform, the actual execution of the transport service is the responsibility of the Supplier.

The Platform does not guarantee:

  • The availability, punctuality, quality, or suitability of the vehicles;

  • The qualifications, professionalism, or behavior of the Supplier's staff;

  • The proper execution of the transport service according to the modalities agreed upon with the User;

  • Connections with other means of transport or compliance with schedules outside the booked service.

Except in cases of proven willful misconduct or gross negligence by the Platform, BusForFun shall under no circumstances be held liable for: delays, cancellations, or modifications of the service; damages to persons, property, or luggage occurring during transport; disruptions caused by external events, such as traffic, weather conditions, strikes, accidents, road closures, public order issues, or force majeure events; indirect economic or financial losses, such as missed connections, failure to attend events, or loss of earnings; or the behavior of the Supplier's staff or passengers.

The User agrees to indemnify and hold BusForFun harmless against any claim, legal action, demand for compensation, or complaint arising directly or indirectly from the execution of the transport service booked through the Platform, except for damages resulting from willful misconduct or gross negligence related to the Platform itself.

Any disputes relating to the transport service may be submitted through the Platform, which will provide operational support as a courtesy, without assuming any direct responsibility for the outcome of the dispute.

FORCE MAJEURE

A "force majeure" event is defined as any unpredictable, extraordinary, and unavoidable event that is beyond the control of either Party, the occurrence of which is not due to actions or omissions attributable to said Party, and which, by its nature and extent, obliges the Party to perform a positive or negative act incompatible with even the partial fulfillment of their contractual obligations. By way of example and not limitation, force majeure includes the following events: pandemic, war, military mobilization, insurrection, requisition, international sanctions, seizure, embargo, general strike, labor disputes, lockdowns, transport blockades, natural disasters, catastrophes, fires, adverse weather conditions, riots, nuclear fission, atmospheric discharges, floods, terrorist acts, corporate disasters, and similar events, even if they affect one's own supply chain of necessary components and services.

Should such types of events occur, the Party intending to invoke force majeure must notify the other, indicating the specific effects of these events on the execution of the contractual obligations. In this case, the Parties shall consult each other to take the necessary actions and find a possible solution to cancel and/or mitigate the effects of such events. In any case, the Party invoking force majeure must demonstrate that their failure to perform was caused by an event beyond their control and free from fault on the part of said Party; they must therefore demonstrate their adherence to the rules of ordinary diligence in order to foresee and prevent, as much as possible, the occurrence of the connected and consequential effects of such events, which could not reasonably be avoided and/or remedied. Force majeure cannot be invoked for breaches already in progress at the time the force majeure event occurs.

With reference to an emerging Pandemic, neither Party may invoke force majeure concerning any events or acts of the Authority that were already known at the time of signing this Agreement, while they may invoke it in the case of regulatory measures or developments in the health situation that could not have been foreseen using ordinary diligence subsequent to the signing of the Agreement.

If the force majeure event persists beyond the suspension period agreed upon by the Parties, either Party shall have the right to withdraw from this Agreement, without any claim for compensation or damages being advanced as a result of such withdrawal. In any case, what has already been executed by the Parties and the obligations accrued up to the date of withdrawal shall remain unaffected.

Purely by way of example, the following constitute force majeure events or events beyond the control of BusForFun:

  • Variation of the planned itinerary due to road closures caused by weather conditions, the closure of mountain passes or roads due to snow, the holding of sporting events, demonstrations, obstacles, dangerous situations, or any other type of problem not attributable to it;

  • Inability to proceed due to unforeseeable circumstances, roadblocks, strikes, lockouts, work stoppages, terrorist activities, natural or nuclear disasters, fires or severe weather conditions, unforeseeable transport problems, closure or congestion of ports and airports, accidents on the service route, unexpected traffic, riots, technical problems, or local unrest;

  • Technical problems or the possible breakdown of the rented vehicle during the trip, except in cases of willful misconduct or gross negligence by BusForFun and/or its Supplier. If a breakdown or technical problem occurs, and/or the transport must be interrupted due to vehicle failure, BusForFun undertakes to organize a substitute service to allow the User to reach the final destination, and will do its best to have the service continue with the least possible inconvenience to the passengers. The cost of the substitute service will be borne by BusForFun.

 

Payment Methods

Complaints and Refunds, Compensation Requests and User Protection

 

BusForFun operates in compliance with current regulations, including Article 1681 of the Civil Code regarding carrier liability.

In the event of a cancellation of the service, significant delay upon departure or arrival, or interruption of the trip attributable to BusForFun or the Supplier, the passenger is entitled, within the limits and as provided for by these General Terms and Conditions, to any applicable assistance measures, a refund of the service price for the unperformed portion, and, where possible, to the rescheduling of the service or rebooking onto an alternative solution at no additional cost.

For private rental services (such as buses, minibuses, or vans with a driver booked on an individual or collective basis), refunds in the event of cancellation, delay, or interruption attributable to BusForFun or the Supplier will in any case be limited to the price of the unused service or, where possible, the rescheduling of the same, excluding any further form of indemnity, compensation, or damages, except in cases of willful misconduct or gross negligence.

With reference to services organized for events, demonstrations, concerts, trade fairs, or other initiatives characterized by a high concentration of demand, the Customer acknowledges that such services are subject to advance planning and unalterable operational constraints; therefore, in the event of cancellation or modification attributable to BusForFun or the Supplier, only a refund of the price of the unused service will be granted, excluding further indemnities or compensation, except in mandatory cases provided by law.

Any assistance measures during the waiting time may be provided at the discretion of BusForFun and consistent with the specific circumstances, within the limits of what is possible and depending on the duration of the disruption.

In any case, any refund or compensation is excluded if the cancellation, delay, or interruption of the service is caused by unforeseeable and unavoidable circumstances not attributable to BusForFun or the Supplier, such as, by way of example and not limited to, adverse weather conditions, natural disasters, health emergencies, acts or measures by authorities, strikes, traffic restrictions, or exceptional traffic conditions.

Requests for refunds, complaints, or compensation must be submitted to BusForFun's Customer Service at the e-mail address info@busrapido.com no later than 3 months from the date the service was performed or should have been performed, accompanied by appropriate documentation. BusForFun will provide feedback within a reasonable time and, in any case, within 30 days of receiving the complaint, with a final response within 90 days.

Any approved refunds will be issued within a reasonable time and in any case no later than 14 days from the relevant confirmation, using the same payment method used by the passenger, unless otherwise agreed.

 

User Protection and Applicable Law

These Conditions are governed by Italian law and must be interpreted in compliance with the mandatory provisions provided for the protection of consumers.

In any case, the User's right, if qualifying as a consumer under current legislation, to avail themselves of the protections provided by the Consumer Code (Legislative Decree 206/2005) and any other applicable legislation regarding passenger rights and carrier liability remains unaffected.

Nothing in these Conditions shall be interpreted as a limitation or exclusion of the rights granted to the User by mandatory provisions of law.

The User retains the right to resort to alternative dispute resolution tools provided by current legislation, including the European ODR (Online Dispute Resolution) platform.

The jurisdiction of the regulatory and supervisory Authorities for the protection of passenger rights remains unaffected.

Any complaints or claims for compensation against the Transport Service Supplier must be submitted in accordance with the procedures described in Article 11. "Correspondence and further communications" of the BusForFun Terms and Conditions of Service. Complaints and requests must be sent as soon as possible, and in any case within the 30 days prior (if applicable) to the start of the Transport Service. Complaints and requests received after the said 30-day period (where applicable) will be rejected, and the claimant must waive all rights to compensation (for damages or costs).

Any discrepancies or inconsistencies regarding the Transport Service booked on the Platform (for example: a vehicle with inferior characteristics compared to the booked vehicle) must be reported in writing via email to info@busrapido.com at the beginning of the trip; otherwise, any subsequent complaints or claims for compensation will be deemed invalid.

For requests received after the 30-day period, BusForFun may, in exceptional cases and at its sole discretion, decide to offer the User a travel credit of an amount lesser than or equivalent to the requested amount. The duration of the credit is 365 days, after which the credit will be considered expired.

 

Right of withdrawal - Cancellations and refunds

Here is the translation of the cancellation and refund policy, maintaining the specific legal references and professional tone:


The services offered through the platform consist of passenger transport services with a specific date or period of execution; therefore, pursuant to Art. 59 of Legislative Decree 206/2005 (Consumer Code), the right of withdrawal as set forth in Art. 52 et seq. of the same decree does not apply to customers qualifying as consumers.

Nevertheless, the user has the right to request the cancellation of the booking at any time before the start of the service by providing written notice to info@busrapido.com. In the event of cancellation, the following penalties shall apply, calculated on the total amount of the booked service:

  • In the event of cancellation made with more than 30 days' notice prior to the service date, a full refund (100%) will be granted;

  • In the event of cancellation made between 30 and 15 days before the service, a refund equal to 70% of the total amount will be granted;

  • In the event of cancellation made between 14 and 7 days before the service, a refund equal to 30% of the total amount will be granted;

  • In the event of cancellation made between 6 days and the day of the service itself, or in the case of a no-show, no refund shall be due.

The penalties applied are established pursuant to Art. 1322 and 1373 of the Italian Civil Code and constitute a pre-estimated and flat-rate liquidation of the damages resulting from the cancellation, taking into account the organization of the service, resource planning, and costs incurred. Any refunds, where due, will be processed within a reasonable timeframe—and in any case at least 7 days and no later than 14 days from the confirmation of the cancellation—using the same payment method employed by the Customer, unless otherwise agreed.

For customers acting in the exercise of entrepreneurial or professional activities (B2B), the provisions of the Consumer Code DO NOT apply, and these conditions fully govern the right of cancellation and the related economic effects, unless otherwise agreed in writing between the parties.

 

Highway Code

For everything not expressly governed by these Conditions of Carriage, the current provisions of the Highway Code (Legislative Decree April 30, 1992, n. 285) and national legislation regarding the transport of persons shall apply. Vehicle Insurance
The vehicles are regularly insured in accordance with current legal provisions and the maximum coverage varies based on the vehicle booked on the Platform.
